This seems like chapter two of the controversy over whether or not teaching assistants are primarily employees or primarily students. The CLinton Labor Board said they were employees at NYU. The Bush Labor Board reversed and said they were students at Brown.
You can be confident we haven't heard the end of this one either. Northwestern now can forum shop… appealing either to their home court of appeals or the D.C. Circuit, which rends to run to the conservative side.
