Part One: Fishing for Clients with “the Internets”

Congrats!  We are connected on LinkedIn, you are my Facebook friend, we are following each other’s’ tweets, and vicariously living each other’s lives through Instagram. 
So … what do we do now?  Why don’t I have any new clients?  And who exactly are 90% of these strangers I’m now allegedly friends with?
Social media and social networking has taken our world by storm, often moving and changing so quickly that it is difficult for most of us to catch up – particularly in a professional setting.  Although new methods of networking, communicating, marketing and branding are literally at our finger tips, the rules that govern our behavior as professional attorneys or accountants date back centuries.  How should we operate and interact with clients, potential clients, opposing parties, and the justice and regulatory systems in general?  Are the established rules of professional conduct too outdated to address ethical concerns of the Social Media Age?  The first segment of this course will address some of the ethical considerations faced by attorneys and accountants as we integrate these interactive technologies and media into our professional practices, particularly with respect to effective networking, marketing, branding, and solicitation.

Part Two: Conflicts, Confidentiality, and CPA/Legal Practices

Once your new client walks through your office doors, what ethical obligations do you have to accurately describe your services and the anticipated results of those services?  What are the most effective ways to identify potential conflicts of interest and resolve them?  How do you balance your client’s confidentiality against competing ethical concerns?  We will cover the most common and the most current ethical dilemmas with respect to preserving the integrity of client relationships.
Additionally, we will examine ethical dilemmas facing multidiscipline practices and partnerships between accountants and lawyers.  From the names on the letterhead to the number of required trust accounts, the increasing frequency of “dual practices” and businesses that provide legal and financial counseling pose serious ethical questions.
In this context, we will also explore the Top Ways a CPA Can Be Sued, including: failing to adhere to professional rules of conduct; failing to memorialize important communication in writing; conflicts of interests; and advising multiple parties involved in a transaction or dispute.

Part Three: Intelligent Lessons from the Idiot Box: Ethics, Movies & T.V.

Hollywood certainly has its opinions about the moral backbone of big business, the financial industry, and the legal profession.  However, are there moral and ethical lessons to be learned from the dramatic roles we know and love in film and television?  We will explore television shows like The Office, Suits, Mad Men, and Seinfeld, and movies like Money Ball, Erin Brokovich, The Client, Philadelphia, Roadhouse, A League of Their Own, and Jerry McGuire.  We will examine how the flawed yet heroic characters in each of these pieces can force us to examine professional integrity, ethical reasoning, and the fear of saying “no” or asking “why?”

The Presenter:

Trial attorney Royce W. Mr. Smith has been recognized by Thomson Reuters, published annually in Philadelphia magazine, as a Pennsylvania Super Lawyer® in 2013 and was also named a Pennsylvania Super Lawyer® Rising Star 2012, 2011 and 2010.  He has also been selected as a member of The National Trial Lawyers Association: Top 40 under 40, a professional organization of America's top trial lawyers.  Most recently, Smith was recognized by Best Lawyers in America in the specialty of personal injury law.  A frequent author and public speaker, Smith is a regular guest on local broadcast news and radio outlets.  Smith is also the founder of www.talktoyourdoctor.org, a community education website, monthly newsletters, twitter-feed, and presentation series to help patients communicate with their physicians about health, screenings, and healthy lifestyle choices.
