“NCAA President Mark Emmert has made a misleading, damaging
and untrue statement (AP) when he included Joe Paterno on his list
of coaches that were fired for ‘misdeeds.’ Mr. Emmert should know
that before you bunch everyone together and pass judgment, you
must first get all the facts and the truth about each one. Obviously,
he didn’t.
3 Coaching Contracts: When is a Done Deal
Done?
A recent appellate court decision in Minnesota has affirmed a trial
court’s jury verdict holding basketball coach Tubby Smith and the
University of Minnesota responsible for damages caused to Jimmy
Williams. Williams, a long-time assistant coach, was awarded in
excess of $1.2 million in May of 2010 for the treatment he received
when he was offered a job as an assistant coach on the staff being
assembled by recently hired head coach Tubby Smith. The offer was
subsequently withdrawn, based on NCAA infractions that had
occurred 25 years earlier when Williams was an assistant for then
head coach Bill Musselman.

Director
Diane Stark, a former University of Southern Mississippi (USM)
athletic department administrator has filed a complaint with the
Equal Employment Opportunity Commission in Jackson against
current interim USM athletic director Jeff Hammond.

A year after the issuance of the Department of Education (“DOE”)
Office of Civil Rights’ (“OCR”) April 4, 2011 “Dear Colleague
Letter,” educational institutions are still scrambling to avoid being
found in violation of Title IX.
7 Negligence Claim Dismissal Affirmed
A panel of judges from the 11th U.S. Circuit Court of Appeals has
affirmed a district court’s decision to dismiss a claim brought by
a former Auburn University football player, who sued a former
trainer at the school and others for allegedly mismanaging his rehabilitation
from back surgery, causing him to suffer a career-ending
back injury.
8 Name & Likeness Plaintiffs Thwarted
A federal judge from the Northern District of California delivered
another blow to the plaintiffs in the In Re NCAA Student-Athlete
Name & Likeness Licensing Litigation when it denied their motion
to compel the Big Ten Conference, the Big Ten Network, and Fox
Broadcasting Company to produce certain documents.
9 Education Department, Butler Agree
The U.S. Department of Education has announced that its Office
for Civil Rights has entered into a resolution agreement with Butler
University in Indianapolis to resolve a compliance review that was
initiated at the university.
9 Feds Enter Sexual Harassment Scandal
The U.S. Department of Education will be joined by the U.S. Justice
Department (DOJ) in its investigation into how sexual assaults
are handled at the University of Montana (UM) and in Missoula.
