The Board reportedly is in Governor Perry's pocket.

The University suffered a set back in the Fisher case in which the SCOTUS held 5-4 that "strict scrutiny" is the test under which a preferential admission program must be analyzed.  Under the UT Austin scheme, the top 10% of all Texas HS grads gained admission to the flagship school.

Obviously such work-arounds of the SUpreme Court's outlawing of minority quotas was no darling of Governor Perry.
