UT-Austin wins back at the Fifth Circuit.

When the Supreme Five ruled in Fisher that
strict scrutiny
must be applied to the
Texas
scheme of admitting the top ten percent of high school grads to its
flagship university
, no doubt the quintet assumed that this would sink this
affirmative action
program. But rather than slit the program's throat themselves, they remanded the case back to the
Fifth Circuit Court of Appeals
to do the dirty work. Well, guess what? The circuit court ruled that the UT approach withstands strict scrutiny.
